Terms of use.

These Terms of Use (“Terms”) govern your access to and use of striveptandperformance.com(the “Site”), operated by Strive PT & Performance (“Strive,” “we,” “us,” or “our”), a sole-practitioner physical therapy practice owned by Dr. Robin Taylor, PT, DPT, located in Andover, Massachusetts. By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

No medical advice

The information on this Site is provided for general educational purposes only and is not medical advice. Reading the Site does not establish a therapist-patient relationship. Nothing on this Site is intended to diagnose, treat, cure, or prevent any medical condition.

Always consult a qualified clinician before starting, stopping, or modifying any treatment, exercise program, or rehabilitation plan. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

Treatment requires an in-person evaluation

Physical therapy care from Strive is provided exclusively in person at our Andover, Massachusetts studio, following a one-on-one evaluation by Dr. Taylor. Information presented on the Site is not a substitute for that evaluation. Massachusetts is a direct-access state, but treatment plans are tailored to the individual after examination.

Booking and cancellations

Appointments are scheduled through Square Appointments, a third-party service. When you book through our scheduling link, your interaction is subject to Square’s Terms of Service and Privacy Policy.

Our cancellation policy is presented during the booking flow and at the time of your first visit. We ask for as much advance notice as possible if you need to reschedule.

Payment

Strive is out-of-network and operates on a cash-pay basis. We accept payment by credit card, HSA, and FSA. We do not bill insurance directly. Upon request, we provide superbills you may submit to your insurer for possible reimbursement under your plan’s out-of-network benefits. Reimbursement is determined entirely by your insurer and is not guaranteed by Strive.

Intellectual property

All content on the Site — including text, graphics, logos, photographs, video, and the visual design — is the property of Strive PT & Performance or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. You may view and share the content for personal, non-commercial purposes. You may not reproduce, modify, republish, or distribute it commercially without prior written permission.

Content on the Resources page that links to articles or videos published elsewhere remains the property of its respective authors and publishers.

Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any part of the Site, related systems, or networks
  • Interfere with the operation of the Site or any user’s use of it, including by introducing malware or excessive automated requests
  • Scrape, harvest, or republish substantial portions of the Site’s content without permission
  • Impersonate Strive, Dr. Taylor, or any other person, or misrepresent your affiliation with us

Contact information — not for marketing or data aggregation

The phone number, email address, and any other contact details published on this Site are provided solely so that patients and prospective patients can reach Dr. Taylor about care at Strive PT & Performance. They are not made available for any other purpose.

You may not collect, scrape, harvest, copy, sell, share, or otherwise use this contact information for: marketing or promotional outreach; lead-generation; inclusion in commercial directories, mailing lists, or databases; training of machine-learning models; or any other form of data aggregation. Unsolicited marketing — including emails, calls, faxes, or text messages — sent to these addresses violates these Terms and may violate the federal CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and Massachusetts consumer-protection law (M.G.L. c. 93A).

Third-party links and services

The Site may link to third-party websites or embed third-party content (for example, YouTube videos on the Resources page). We provide these links for convenience and do not control or endorse their content. Your use of any third-party service is governed by that service’s own terms and privacy policies.

Disclaimers

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Strive disclaims all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that the Site will be error-free, secure, or available at any particular time or location.

Limitation of liability

To the fullest extent permitted by law, Strive PT & Performance, Dr. Robin Taylor, and our agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or related to your use of the Site will not exceed one hundred U.S. dollars ($100).

Nothing in these Terms limits liability that cannot be excluded under Massachusetts or federal law, including any liability arising out of the provision of in-person physical therapy services, which is governed by applicable healthcare and professional-liability laws and not by these Terms.

Indemnification

You agree to indemnify and hold harmless Strive PT & Performance and Dr. Robin Taylor from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms.

Privacy

Our handling of information collected through the Site is described in our Privacy Policy. By using the Site you consent to that policy.

Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law provisions. Any dispute arising out of or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Essex County, Massachusetts, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page will reflect the most recent revision. Material changes will be posted to this page; continued use of the Site after a change constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
